The tutor will provide music lessons via an agreed to online teaching platform (in this instance, Skype).
The tutor will provide an agreed schedule of lessons detailing dates and times prior to the lessons commencing. The dates and times of the lessons may be changed if both student and tutor agree.
It is the students (or student’s parent, guardian or carer) reasonability to inform the tutor any medical conditions which may affect the online learning experience.
Fees will be charged on a per hour basis. Pro rata for any part of an hour. The fee may be paid in advance or pay as you go. But the fee must be paid in full before the lesson.
The tutor may serve a written notice of an increase in fees to the student (or students’ parent, career or guardian, where appropriate) by no later than the start of the term preceding the term when the increase in fees will take effect.
The tutor will provide the student (or student’s parent, guardian or carer) written confirmation of the start date and time of the lessons. If the student choses to have reoccurring lessons and the date and time changes this has the be agreed by both the teacher and the student. The tutor must be given 24 hours’ notice. The tutor will send confirmation to the student (or student’s parent, guardian or carer) of these changes.
The tutor will charge for any missed lessons which the student does not attend, unless the tutor chooses not to do so, due to existential circumstances. If the tutor cancels a scheduled lesson. The student (or student’s parent, guardian or carer) may choose between (i) a refund of the missed lesson, (ii) carrying the lesson forward (iii) rescheduling the missed lesson.)
Examination, Competitions and Public Performances
The student will not be entered into an exam, public performance, competition without the prior consent of both the student (or student’s parent, guardian or carer if the student is under the age of 18) and the tutor.
The student (or student’s parent, guardian or carer) will not make any unlawful photocopies of music.
The student (or student’s parent, guardian or carer) has the right to cancel the lessons and receive a refund. To cancel the agreement the student (or student’s parent, guardian or carer) must write an email to the tutor. The cancelation period commences from the start date of the agreement and ends 14 days later. The tutor will confirm the receipt of the email and issue a refund for any lessons that where paid in advance. Reimbursement will be made using the same payment method for the initial purchase of the online music lessons.
(a) The agreement of tuition may end at any time by both signatories to signing and dating a written statement.
(b) If fees are not paid on time, the teacher reserves the right (at the tutors’ discretion) to terminate the agreement to immediate effect by given a written notice to the student (or student’s parent, guardian or carer) This right to terminate is without prejudice to any other rights the tutor may have.
(c) To terminate this agreement the by giving two weeks’ notice.
Failure to give notice
If the student stops attending to the appointed lessons without any written notice, the student (or student’s parent, guardian or carer) is not entitled to any refund of any fees that have been paid in advanced. Any lessons that are already paid for the student has the right to attended.
If the tutor fails to attend the appointed lesson without given any notice. The tutor will refund the fess for any lesson that have been paid in advance if the lesson does not take place due to the teacher not giving any notice.
At the tutor’s discretion, if the teachers feel that they are uncomfortable or unable to continue to the student due to defamatory, offensive or illegal aired online by the student or inappropriate conduct caused by the student (or student’s parent, guardian or carer), the tutor has the right to stop the lessons. Any remaining lessons that where paid in advanced will not be refundable.
Any changes made in this agreement must be confirmed by both the student (or student’s parent, guardian or carer) and the tutor in writing, dated and signed.
If the tutor decided to relinquish any right or solution under this agreement or otherwise (for instance, if the tutor decides to relinquish the fees if the student does not attend the lessons) this does not be mean that they must do so in the future or that they relinquish any other rights or remedies unless this is agreed between the student (or student’s parent, guardian or carer)
Communication between the parties
For the purposes of this Agreement written notice must be given on by email or paper.
Space and equipment
The student (or student’s parent, guardian or carer) is responsible for providing a suitable space and technology which is appropriate for online learning. This will be advised by the tutor.
Both tutor and student should present against a neat and tidy background when using video. When the online lessons commence the student (or student’s parent, guardian or carer) must ensure that the area is suitable for receiving online lessons for instance,the room or space where the lesson will take place must be quiet so that the student and the tutor are able to hear each other during the lessons.
The tutor is not responsible to loan/purchase any equipment or materials for the student (e.g. computers. Tables cameras, sheet music etc.)
The student (or student’s parent, guardian or carer) is responsible that the online teaching platform recommended by the teacher is installed and working prior to the first lesson. All and any technical issues should be referred to the software/platform provider.
Any materials provided by the teacher electronically remain the Intellectual Property of the tutor.
The tutor is not responsible for any technical failures, issues or damages of equipment used at the student (or student’s parent, guardian or carer) premises or elsewhere for the purpose of receiving online music lessons. The tutor will not be required to make up any lost time caused by such failures, issues or damages. Moving equipment in order to enhance the quality of the video/audio is done at the students (or student’s parent, guardian or carer) risk.
The tutor is not responsible to make up any lost time due to poor broadband connection, technical issues, poor sound or video quality, computer software and hardware problems that might occur at the students (students carer/guardians) home or other location used for online learning.
The students (student's carer/guardian) are responsible for the insurance of the student’s instrument and all equipment used by the student for online teaching.
The student (student's carer/guardian) will not make any unlawful photocopies of music.
If the student is under the age of 18 the student’s paper/carer/guardian must be present in the room and all communication will take place through the student parents/ carers/ guardian’s email/ Skype account. Under no circumstances the student should contact the tutor directly. If the lesson needs to be cancelled or rescheduled this need to be comminated by the student’s carer/ guardian via email or telephone.
If the student is over the age of 18 all communication must be done via email or phone. If the students is over the age of 18 and need to cancel the student can contact the teacher via telephone or email at the tutor's discretion.
The student (student's carer/guardian) should limit their profile on the teaching app and use setting to maximise privacy the teacher will do the same.
The online teaching platform is only for education use only and must not be used for any other purpose.
Both the tutor and student must dress appropriately for the online lesson.
Privacy and recordings
The Skype account will be used exclusively for the purpose of lessons and only during music lessons. If the student (the student’s parent or carer guardian) would like the sessions to be recorded they must have written confirmation to this, before the lesson starts. Both the student (the student’s parent or carer guardian) and the teacher must have a written agreement to record. Under no circumstances will the student (the student’s parent or carer guardian) and the tutor share, or post to social media any recordings and they will securely delete and dispose of any recording of the teaching as soon as possible on the tutor's request.
The tutor agrees to comply with all applicable laws, statutes, regulations including in relation to privacy, confidentiality, the protection of personal data and GDPR.
Governing law and jurisdiction
This Agreement shall be subject to the laws of the jurisdiction of the location for the lessons (specified above) and the signatories to this Agreement agree that any dispute relating to the subject matter of this Agreement shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
